Company Set Up
We are your one-stop shop for company set up services in Australia. We assist entrepreneurs and small business owners with the formation of their businesses. Our team of knowledgeable lawyers can walk you through the process with ease.
We can help you with everything from picking the ideal business structure, to registering with the correct government bodies.
Why set up a company through a lawyer?
While you can register an Australian company directly through ASIC or other sites, registering through The Legal Shop means you have an experienced lawyer to:
- Explain and help determine what the most appropriate structure is, which can save you from potential liability
- Provide company secretary legal documentation required under the Corporations Act, such as company formation meeting minutes, registered office consents, director/secretary consents and company registers
- Draft a constitution tailored to your business rather than relying on the default replaceable rules: we’ve written about why that matters
When you are starting a new company, the last thing you want is to start off with the wrong foundation.

Frequently asked questions
What do I get that I wouldn’t get registering directly with ASIC?
Registration is the easy part. What DIY registration doesn’t give you: structure advice before you commit, a tailored constitution instead of the default rules, the company secretary documents the Corporations Act requires, and founder documents that prevent co-owner disputes. We set all of it up together.
Do I need a constitution or will the replaceable rules do?
The replaceable rules are a default that fits few real businesses, and they leave gaps around director appointments, share transfers and decision-making. A tailored constitution closes them: see our guide on why small businesses need a company constitution.
We’re two founders. What else should we put in place?
A shareholders agreement, ideally at set-up: it settles money, control and exits while everyone agrees.
How long does company set up take?
Once we have your details and instructions, registration itself is usually fast; the full set-up with tailored documents is typically completed within 5 working days.
